Indocare complies with high ethical standards for the recruitment of nurses from third countries. We place staff from India to Germany.
Declaration Of Principles
In line with the United Nations Guiding Principles on Business and Human Rights it shall be ensured that our company understands its duty of care regarding the adherence to human rights. Therefore, our company has Policy Statements, containing our commitment to the adherence to the international standards concerning the protection of human rights and occupational safety.
We committed ourselves to fair and ethical recruitment and personnel placement practices in accordance with the six guiding principles of the RAL Quality Mark “Faire Anwerbung Pflege Deutschland”. Those are:
We record any contracts, the General Terms and Conditions, specific job offers as well as any information for Nursing Professionals in writing. This does not only ensure the objective verifiability during the review process, but also provides a reliable and transparent point of reference. All relevant documents shall be provided in a timely manner and compiled specifically for the recipient. The documents shall be provided in a language the Nursing Professional understands, so that they are able to acknowledge the contents thereof.
We do not charge the Nursing Professional any direct or indirect personnel placement costs nor do we charge any costs arising from services in direct connection with the personnel placement (Employer Pays Principle). This shall apply to the entire service chain. In accordance with the ordering principle [Bestellerprinzip], the employer shall bear any costs arising from the recruitment. Should the Nursing Professional have incurred costs for the purpose of language acquisition before the personnel placement process has started, we shall ensure that they are reimbursed for such expenses.
We shall ensure that the economic risks of recruiting professionals from abroad shall be shifted to the Nursing Professional to a limited extent at most. Any contractual terms demanding repayments from the Nursing Professional shall only apply if the personnel placement process cannot be completed as planned. Any such repayments may only be effected if they are concerning costs incurred, firstly, in actual fact and, secondly, in the country of origin. Any contractual repayment clauses shall be agreed upon in writing and the parties must be aware of them before the conclusion of contract. The Nursing Professional must expressly consent to such contractual clauses.
We shall ensure that all parties participating in the personnel placement process are able to make absolute, competent and fully informed decisions at all times during the recruitment and that they are to be acknowledged as equal partners. For this purpose, we shall, from the start, give all parties transparent explanations on the manner in which the personnel placement process is to be performed as well as on any costs that might be incurred.
It is our belief that all Nursing Professionals should enter into long-term employment. We therefore clarify in advance what the Nursing Professional and the employer may expect from each other, from the job itself as well as from the German market for care workers in general.
Our company understands its great responsibility towards any Nursing Professionals, employers and the nursing care sector. We therefore utilize an inclusive approach to the recruitment process, any procedures are to be reviewed and called into question on a regular basis, and we monitor ourselves, so that our principles are strictly adhered to.
We committed ourselves to the adherence to the WHO Global Code of Practices on the International Recruitment of Health Personnel. This means in particular that we do not undertake any recruitments in countries included on the currently applicable WHO health workforce support and safeguards list.
We shall adhere to any international human rights standards, in particular to the ILO Kernarbeitsnormen, the ILO General principles and operational guidelines for fair recruitment and definition of recruitment fees and related costs, the United Nations Guiding Principles on Business and Human Rights as well as any international human rights instruments of the UN.
Within the personnel placement contracts concluded between us and the Nursing Professional, we shall waive any impermissible commitment and repayment obligations. We shall be obligated to not undertake personnel placements with care companies whose employment contracts contain commitment and repayment obligations concerning any costs arising from the personnel placement.
Furthermore, the following standards apply when concluding a contract with Indocare:

3. Compliance with international human rights conventions International Human Rights Law | OHCHR
4. Compliance with the ILO core labor standards Labor standards (ilo.org), in particular the general principles and operational guidelines for fair recruitment
5. Compliance with IRIS standards
Indocare commits to:
1. to waive commitment and repayment obligations in the placement contracts with the nursing professionals, taking into account the exceptions mentioned in criterion 3.4
2. not to place employment contracts that contain commitment and repayment obligations that relate to the costs of the placement
